Amazon wins longstanding ‘appstore’ battle against Apple

[ 0 ] Posted by on July 7, 2011

iPhone AppstoreThe title says it all really. In the midst of Apple trying to legally bully out all competitors who mention the word ‘Appstore’ in their material, Amazon has just very recently won a case, where Apple filed a request to immediately stop Amazon from using the term ‘Appstore’ all the way back in March. Being put in their place, Apple has been told by a federal judge in the US that they as a company had failed to show Amazon’s use of the widely generic term, and stopping it would confuse customers.

In the 18 page verdict delivered in the US, federal judge Phyllis Hamilton said that “Apple has not established that its “App Store” mark is famous, in the sense of being “prominent” and “renowned””. This legal triumph from Amazon marks the very first win for a company in the ongoing cases Apple files against them.
