Microsoft files objection to Apple’s ‘App Store’ Trademark

PC World has recently gained news that Microsoft has challenged Apple’s ‘app store’ trademark application by filing a motion for a summary judgment that would deny Apple the trademark for the term ‘app store’.

“Too Generic”

According to Microsoft, Apple has unfairly prevented other companies from referring to their application retail stores as app stores, and have stressed that the term ‘app store’ is far too generic to be trademarked by a company of any size. Microsoft have also stated that they want to be able to use the term app store as freely as they like.

Apple filed for this trademark all the way back in 2008  for the phrase iPhone App Store, however Microsoft have only just filed this objection.

The trademark request describes the App Store as “a retail store services featuring computer software provided via the internet and other computer and electronic communication networks; Retail store services featuring computer software for use on handheld mobile digital electronic devices and other consumer electronics.”
