IPCom hoping to get a ban on German HTC smartphones

If a company out there is using technology patented by you and they aren’t licensing it then you’ll set up a lawsuit against them, simple, and that’s exactly what IPCom have done. IPCom have filed a lawsuit against smartphone maker HTC in Germany with claims that the companies 3G devices (that’ll be all their smartphones) infringe on one of its patents related to user priority assignment protocol.
Interestingly, HTC appealed against this patent lawsuit in a filing however later withdrew it, leading many industry analysts to presume HTC knew they have no chance of getting off this one. With this news, ICPom have gone all out and are now seeking not just industry clarification that HTC aren’t paying their way but they also want HTC smartphone sales banned in Germany. Not a smooth move on HTC’s part for sure.
“Since HTC has never to come up with an offer that adequately reflects the value of these patents, IPCom has been left with no choice – we will use the right awarded by the courts, likely resulting in HTC devices disappearing from shops during the crucial Christmas season.” said Bernhard Frohwitter, managing director at IPCom.
